1. Introduction

Welcome to SpiritAlert. By accessing and using our service, you agree to comply with and be bound by the following Terms and Conditions. Please review them carefully. If you do not agree to these Terms, you should not use our service.

2. Service Description

SpiritAlert provides an alerting service for travelers unable to book a voyage on the Spirit of Tasmania due to limited carrying capacity. Users can enter their trip details, and SpiritAlert will periodically scan for availability changes and alert the user via email and SMS if a booking becomes available.

3. No Affiliation

SpiritAlert is in no way affiliated with Spirit of Tasmania (TT-Lines). Bookings are made directly with Spirit of Tasmania (TT-Lines).

4. No Guarantee

SpiritAlert does not guarantee the availability of bookings and is not liable for any damages or losses incurred by the user due to unavailability.

5. Paid Plans

All paid SpiritAlert plans are one-time arrangements and are non-refundable.

6. User Responsibilities

  • Users are responsible for providing accurate and up-to-date trip details.
  • Users must ensure that their contact information (email and phone number) is correct to receive alerts.
  • Users are responsible for ensuring they have mobile service or internet access to receive notifications from SpiritAlert.

7. Limitation of Liability

To the fullest extent permitted by law, SpiritAlert shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use our service;
  • Any unauthorized access to or use of our servers and/or any personal information stored therein;
  • Any failure by the user to receive notifications due to lack of mobile service, internet access, or incorrect contact information.

8. Indemnification

You agree to indemnify, defend, and hold harmless SpiritAlert, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Service;
  • Your violation of any term of these Terms;
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

9. Modifications

SpiritAlert reserves the right to modify or replace these Terms at any time. It is your responsibility to check these Terms periodically for changes. Your continued use of the service following the posting of any changes to these Terms constitutes acceptance of those changes.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Tasmania, Australia, without regard to its conflict of law provisions.
